EngineerSpeak Terms of Service

These Terms of Service govern your access to and use of the EngineerSpeak website, applications, interview practice tools, AI-powered feedback, speech-processing features, question libraries, and related services.
Welcome to EngineerSpeak
These Terms of Service ("Terms") govern your access to and use of the EngineerSpeak website, applications, interview practice tools, AI-powered feedback, speech-processing features, question libraries, and related services (collectively, the "Service").
By accessing or using the Service, creating an account, or purchasing access to paid features, you agree to these Terms.
If you do not agree to these Terms, you must not use the Service.
1. About EngineerSpeak
EngineerSpeak is an educational and interview-preparation platform designed to help software engineers and other technical professionals practice technical interviews, improve spoken technical communication, and receive automated feedback.
The Service may include technical interview questions, reference answers and explanations, simulated technical interviews, speech recognition, technical answer evaluation, English-language and communication feedback, AI-generated recommendations and explanations, interview history and progress tracking, paid access passes, credits, or usage allowances, and other related educational tools.
EngineerSpeak is an interview preparation service. It is not a recruitment agency, employer, certification authority, or guarantee of employment.
2. Eligibility
You must have the legal capacity to enter into these Terms under the laws applicable to you.
If you use EngineerSpeak on behalf of a company or other organization, you represent that you have authority to accept these Terms on its behalf.
Where local law requires parental or guardian consent for use of an online service, you may use EngineerSpeak only with the required consent.
3. User Accounts
Certain features of EngineerSpeak may require an account. You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials, activity performed through your account, and notifying us if you believe your account has been compromised.
Accounts and paid access are intended for the registered user unless EngineerSpeak expressly provides a team or organizational plan. You may not sell, rent, transfer, share, or commercially redistribute access to your account.
We may suspend or restrict an account where we reasonably believe that there has been a violation of these Terms, fraudulent activity, unauthorized account sharing, attempted circumvention of usage limits, abuse of the Service, a security risk, or non-payment.
4. AI-Generated Content and Quality Review
EngineerSpeak uses artificial intelligence systems to generate, review, analyze, and evaluate technical interview content and user responses. This may include technical questions, reference answers, explanations, scores, language feedback, and other recommendations.
Multi-model review
As part of our quality-control process, content may be independently generated or reviewed by multiple artificial intelligence models and providers, which may include models provided by OpenAI, Google, xAI, and other providers.
EngineerSpeak uses a multi-model review process designed to identify disagreements, factual inconsistencies, ambiguous questions, and potentially unreliable content. Technical questions and reference answers are made available through the Service only when they satisfy our internal review and agreement requirements. Content that does not reach the required level of agreement or quality may be rejected and excluded from the Service.
No guarantee of correctness
Agreement among multiple artificial intelligence systems does not guarantee correctness. AI systems may contain errors, share similar limitations, rely on incomplete information, misunderstand technical context, or reach the same incorrect conclusion.
Therefore, EngineerSpeak does not warrant that any question, reference answer, explanation, technical score, language score, recommendation, or other AI-generated content is always complete, current, accurate, or error-free.
The Service is intended for educational and interview-preparation purposes. Users should exercise independent judgment and, where appropriate, verify important technical information against authoritative documentation and other reliable sources.
5. Interview Questions and Reference Answers
Technical interviews frequently allow more than one valid solution or explanation. A reference answer provided by EngineerSpeak represents an example of an answer that our systems consider technically appropriate. It should not necessarily be interpreted as the only correct answer.
EngineerSpeak does not guarantee that questions available through the Service will appear in an actual interview, a particular employer will expect the same answer, an interviewer will evaluate an answer in the same way as EngineerSpeak, a particular score will correspond to an employer's assessment, or use of the Service will result in employment, promotion, certification, or successful completion of an interview.
6. Automated Evaluation
EngineerSpeak may automatically evaluate answers based on factors including technical correctness, completeness, relevance, communication quality, language use, and other criteria.
Scores and evaluations are estimates generated for educational purposes. They are not official professional certifications or assessments and should not be treated as definitive measures of a user's professional ability.
Different interviewers, employers, AI systems, or evaluation methods may reach different conclusions.
7. Voice Processing
EngineerSpeak may allow users to answer interview questions using their voice. Raw voice input may be processed for speech recognition and related functionality.
EngineerSpeak does not permanently store raw voice recordings unless we clearly inform the user otherwise before such storage occurs. Where our current technical architecture permits, raw voice recordings are processed only for the period required to perform speech recognition and are then discarded.
Raw voice recordings are not sold or used for advertising. Where raw voice processing is performed entirely within EngineerSpeak-controlled infrastructure, raw voice recordings are not transmitted to external AI providers.
Text transcripts generated from voice input may be stored in order to provide features such as interview history, answer evaluation, progress tracking, personalized feedback, and learning reports.
Text transcripts or portions of them may be processed by third-party AI providers when necessary to generate evaluations, explanations, or other features of the Service. More information about data processing is provided in our Privacy Policy.
8. Paid Access, Passes and Credits
Certain features of EngineerSpeak may require payment. Paid access may be offered in forms including time-limited access passes, interview packages, credits, usage allowances, or other prepaid access models.
The applicable price, validity period, included usage, and other material conditions will be displayed before purchase. Unless explicitly stated otherwise, purchasing a pass or package does not create an automatically renewing subscription.
Validity periods
Some products may be valid only for a specified period. Unused credits or usage allowances may expire at the end of that validity period where this was disclosed before purchase. Expired access or credits do not automatically create a right to a refund.
9. Payments
Payments may be processed by third-party payment providers. By purchasing a paid product, you agree to provide valid payment information and authorize the applicable payment provider to process the transaction.
EngineerSpeak does not necessarily receive or store your full payment card information. Prices and applicable currencies will be displayed before payment. Taxes may be included in or added to the displayed price where required by applicable law.
10. Refunds and Withdrawal
Our goal is to apply refunds fairly while taking into account whether the purchased Service has already been used. Nothing in this section limits any mandatory consumer rights that cannot legally be waived.
Unused purchases
Where permitted under the applicable purchase conditions and applicable law, a substantially unused purchase may be eligible for a refund.
Partially used purchases
Where a user has started using a paid package, pass, or credit allowance, any voluntary or legally permitted refund may be reduced proportionally to reflect the portion of the Service already provided or consumed, where applicable law permits such deduction.
For example, where a package contains a defined amount of usage and a user has consumed part of that usage, the consumed portion may be excluded when calculating the refundable amount.
Fully consumed purchases
A package or usage allowance that has been fully consumed is generally non-refundable, except where a refund is required by applicable law or where the Service was materially defective.
A user may not consume all or a substantial portion of a paid package and then claim a full voluntary refund solely because the user no longer wishes to use the Service.
Immediate performance
Where required by applicable consumer law, we may ask users to expressly request that digital services or digital content begin immediately after purchase and to acknowledge any resulting effect on their statutory right of withdrawal.
Transaction fees
Payment providers may charge EngineerSpeak transaction, processing, currency conversion, refund, or similar fees. Where permitted by applicable law, non-refundable payment processing costs may be taken into account when calculating a voluntary refund.
Mandatory statutory refunds will be processed as required by applicable law regardless of the terms imposed on EngineerSpeak by its payment providers.
Technical failures
If a substantial part of a paid Service cannot be provided because of a verified technical failure attributable to EngineerSpeak, we may, depending on the circumstances and applicable law, restore affected credits, extend the validity period, provide replacement access, issue a partial refund, or issue a full refund.
Temporary interruptions or minor technical issues do not automatically entitle a user to a full refund.
11. Acceptable Use
You agree to use EngineerSpeak only for lawful purposes. You must not:
- attempt to gain unauthorized access to the Service, accounts, servers, databases, or infrastructure;
- interfere with or disrupt operation of the Service;
- circumvent usage, payment, account, or security restrictions;
- create multiple accounts for the purpose of avoiding free or paid usage limits;
- use bots or automated systems to consume the Service beyond explicitly permitted functionality;
- scrape, crawl, systematically download, or mass-extract questions, reference answers, explanations, or other Service content;
- copy or reconstruct the EngineerSpeak question database;
- reverse engineer, decompile, disassemble, or attempt to derive the source code or protected internal logic of the Service except where such restriction is prohibited by applicable law;
- reproduce, redistribute, resell, sublicense, or commercially exploit EngineerSpeak content without authorization;
- use EngineerSpeak content to create a substantially competing interview question database or service;
- systematically use EngineerSpeak content to train or develop competing machine-learning or artificial-intelligence products without our written permission;
- upload malicious code or attempt to compromise Service security;
- impersonate another person;
- use another person's account without authorization; or
- use the Service in violation of applicable law.
12. Interview Assistance and Misuse
EngineerSpeak is primarily designed for learning, practice, and interview preparation. Unless expressly offered as a feature for such purpose, the Service should not be used to misrepresent a user's knowledge or abilities during a real-time employment assessment or examination where external assistance is prohibited.
Users are responsible for complying with the rules established by employers, interviewers, educational institutions, certification providers, and other third parties.
13. Intellectual Property
The EngineerSpeak Service and its original content are protected by applicable intellectual property laws. Except for User Content, EngineerSpeak or its licensors retain all applicable rights in software, source code, website design, branding, logos, user interfaces, interview question collections, question organization and selection, reference answers, educational materials, evaluation frameworks, scoring methodologies, prompts and processing workflows, databases, and other proprietary Service materials.
Using the Service does not transfer ownership of these materials to you. Subject to these Terms, EngineerSpeak grants you a limited, personal, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose.
14. User Content
You retain ownership of content that you submit to EngineerSpeak, including your interview answers and other material you provide.
You grant EngineerSpeak a limited, non-exclusive right to process your User Content only as reasonably necessary to operate the Service, transcribe your answers, evaluate responses, generate feedback, display interview history, maintain security, troubleshoot technical problems, and perform other functionality requested by you.
This license does not transfer ownership of your User Content to EngineerSpeak. Additional information regarding personal data is provided in our Privacy Policy.
15. Third-Party AI and Technology Providers
EngineerSpeak may depend on third-party infrastructure, payment processors, artificial intelligence providers, hosting providers, analytics services, and other technology providers. When necessary to provide a requested feature, relevant data may be transmitted to these providers.
Third-party providers may experience interruptions, outages, errors, or changes that are outside EngineerSpeak's direct control. Where personal data is involved, its processing will be described in our Privacy Policy and handled in accordance with applicable data-protection requirements.
16. Service Availability
We aim to keep EngineerSpeak available and reliable but do not guarantee uninterrupted availability. The Service may occasionally be unavailable because of maintenance, software updates, infrastructure failures, third-party provider failures, network problems, security incidents, capacity limitations, or circumstances outside our reasonable control.
We may modify, add, remove, replace, or discontinue features where reasonably necessary for development, security, legal compliance, or operation of the Service. Where such a change materially affects prepaid access, we will take reasonable steps consistent with applicable law.
17. Changes to Questions and AI Models
Software engineering practices, programming languages, frameworks, interview expectations, and AI technology change over time. EngineerSpeak may therefore update interview questions, reference answers, evaluation methods, scoring criteria, AI providers, AI models, and technical infrastructure without requiring an amendment to these Terms for every individual technical change.
References in these Terms to particular categories of AI providers or technologies are illustrative and do not guarantee continued use of any specific provider or model.
18. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.
EngineerSpeak does not guarantee uninterrupted Service availability, error-free operation, perfect speech recognition, complete or error-free AI output, accuracy of every technical question or answer, any particular interview score, compatibility with every device or browser, success in an employment interview, or any particular professional or employment outcome.
Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.
19. Limitation of Liability
To the maximum extent permitted by applicable law, EngineerSpeak will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of or inability to use the Service, including loss of opportunities, business, profits, data, goodwill, or anticipated employment.
EngineerSpeak is not responsible for employment decisions made by employers, recruiters, interviewers, or other third parties. EngineerSpeak is also not responsible for decisions made by users solely in reliance on AI-generated content where independent verification would reasonably be appropriate.
Where applicable law does not allow certain exclusions or limitations of liability, those exclusions or limitations apply only to the maximum extent legally permitted. Nothing in these Terms excludes liability that cannot lawfully be excluded.
20. Suspension and Termination
You may stop using EngineerSpeak at any time. We may suspend or terminate access where reasonably necessary because of material violation of these Terms, fraud, abuse, security threats, unauthorized extraction of content, payment disputes involving fraudulent use, repeated attempts to bypass Service limitations, or applicable legal requirements.
Termination does not automatically create a right to a refund for Service already consumed. Any mandatory consumer rights remain unaffected.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Service, applicable law, business operations, security requirements, or technology.
The current version and effective date will be published on the EngineerSpeak website. Material changes will not be applied retroactively where doing so would be prohibited by applicable law.
Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms where such acceptance is legally valid.
22. Privacy
Use of EngineerSpeak is also subject to our Privacy Policy. The Privacy Policy describes, among other things, what personal data we process, how voice input is handled, whether transcripts are stored, which types of service providers may receive data, why data is processed, how long relevant information is retained, and what privacy rights may be available to users.
23. Governing Law and Consumer Rights
These Terms are governed by the laws applicable to the entity operating EngineerSpeak, subject to any mandatory consumer-protection rules applicable to the user.
Nothing in these Terms deprives consumers of protections that cannot be waived under the laws applicable to them.
